Introduction

Chevron presents: Energyville™, an energy game developed by The Economist Group.

The Energyville game has been published in multiple portable data storage formats. It can also be played on the Energyville website, www.energyville.com/energyville. These Energyville Terms of Use ("Terms") govern your use of Energyville in all portable data storage formats, and on the web. Chevron reserves the right to change these Terms at any time without prior notice; any changes will become effective upon their posting to the Energyville website. The current version of the Terms can be viewed at any time at: www.energyville.com. If you violate these Terms, Chevron may bar you from further use of Energyville.

Rules of Game Play

The rules of game play are set forth within the game.

Authenticity of Your Email Address

In case you provide an email address for yourself when using the "Send to a Friend" function or the "Challenge a Friend" function, you represent and warrant that the email address does in fact belong to you, and that you are authorized to use it.

Your Right to Submit a Friend's email Address

In case you submit a friend's email address in connection with the "Send to a Friend" function or the "Challenge a Friend" function, you represent and warrant that you have the right to use this email address and disclose it to Chevron, and that you are not using either of these functions to harm or harass anyone. You agree that Chevron is not responsible for the content contained in your email message.

Source of Game Content; Disclaimer

Energyville™ was developed for Chevron by its contractor, The Economist Group, and subcontractor, Picture This Communications, Inc. These contractors provided all content, including facts and events, for Energyville. The structure and functionality of Energyville and the content contained within Energyville are provided "as is" and without warranties of any kind, either express or implied. To the fullest extent permissible pursuant to applicable law, Chevron and the contractors disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose, in Energyville. Neither Chevron nor any of the contractors warrants that Energyville will be error-free, or free of viruses or other harmful components. Neither Chevron nor any of the contractors makes any representations or warranties regarding the correctness, accuracy, or other qualities of the information in Energyville, or regarding the software code contained within Energyville.

The content of Energyville is presented as a courtesy to be used only for informational and educational purposes. Events, comments and factoids presented in Energyville are not intended to express forward-looking statements about Chevron's business goals or practices, nor are they intended to express Chevron's or the contractors' opinions or beliefs about the future of energy. Neither Chevron nor the contractors represent or warrant that the content of Energyville is accurate, complete or current for any specific or particular purpose or application. The Energyville game is © 2007-2011 Chevron Corporation. All rights reserved. You have no right to modify Energyville or make any copies. Energyville is a trademark of Chevron Intellectual Property LLC.

All trademarks, service marks, logos and trade names, whether registered or unregistered, including but not limited to the trademarks of members of The Economist Group, appearing within the Energyville game are proprietary to Chevron or to such other companies. You may not reproduce, download or otherwise use any such trademarks, service marks, logos or trade names without the prior written consent of Chevron, or the appropriate owner thereof.

No Tampering with Energyville

You must not violate or attempt to violate the security of Energyville. Any such violations may result in criminal and/or civil penalties against you. Chevron will investigate any alleged or suspected violations and if a criminal violation is suspected, will cooperate with law enforcement agencies in their investigations. Violations of the security of the game include without limitation: logging into or attempting to log into a server or account that you are not authorized to access; accessing data or taking any action to obtain data, information or services not intended for you or your use; attempting to probe, scan or test the vulnerability of any system or network; tampering, hacking, modifying or otherwise corrupting or breaching security or authentication measures; posting material that contains viruses, Trojan horses, worms, time bombs, cancelbots, corrupted files or other computer programming routines or engines, or engaging in conduct that could damage, disrupt or otherwise impair or interfere with a computer's functionality or the operation of Energyville.

Jurisdictional Issues

The Terms shall be governed by and construed in accordance with the laws of the State of California, U.S.A., without giving effect to any principles of conflicts of law. If any provision of the Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from the Terms and shall not affect the validity and enforceability of any remaining provisions. The Terms represent the entire agreement between the parties relating to the subject matter herein.

Limitation of Liability

To the extent permitted under applicable law, under no circumstances, including, but not limited to, negligence, shall Chevron or the contractors be liable for any compensatory, punitive, special or consequential damages that result from your use of Energyville, even if Chevron, a Chevron authorized representative, or a contractor has been advised of the possibility of such damages. In no event shall Chevron's or a contractor's total liability to you for all damages, losses, and causes of action (whether in contract, tort (including, but not limited to, negligence) or otherwise) exceed the amount paid by you to Chevron, if any, for using Energyville.

Indemnity

You agree to indemnify, defend and hold the contractors and Chevron, its affiliates and any of its and their directors, employees, agents and contractors harmless from and against any and all claims, damages, losses, costs (including without limitation reasonable attorneys' fees) or other expenses that arise directly or indirectly out of or from (i) your breach of the Terms; and/or (ii) your activities in connection with Energyville.

Other Issues

As used herein, the term "Chevron" and such terms as "our," "we" and "us" may refer to one or more or all of Chevron Corporation's consolidated subsidiaries. "The Economist Group" refers to the entities listed as members of "The Economist brand family" at www.economistgroup.com. All of these terms are used for convenience only and are not intended as a precise designation of any of the separate companies, each of which manages its own affairs.

The web-based version of Energyville is posted on the Energyville website, which is accessed via energyville.com. That site is owned and operated by Chevron and should not be confused with any other website whether or not the word Chevron appears as part of the domain name or branding. You are advised to check each web page you visit on or from the energyville.com site to determine whether you have moved onto a third party site.
